Understanding Drug Crimes in Colorado

Drug crimes encompass a wide range of criminal acts and are some of the most serious offenses that the state can pursue against an individual. Drug crimes can range from possession for personal use all the way to interstate or international drug trafficking operations. Penalties for drug crimes can include jail time, probation, fines, and the loss of certain civil rights.

Colorado recognizes four primary categories of drug crimes:

  • Possession of a controlled substance. This can range from the possession of a small amount of marijuana to the possession of a large amount of a controlled substance such as heroin.
  • Possession with intent to sell. This can include the possession of large quantities of a controlled substance, paraphernalia associated with drug use, or other items that indicate an intent to sell.
  • Drug manufacturing. This includes any operation, large or small, engaged in creating a controlled substance, such as manufacturing methamphetamine or ecstasy.
  • Distribution or sale of a controlled substance. This can include the sale of drugs to an individual, or the large-scale sale of a controlled substance.

What are the Penalties for Drug Crimes in Colorado?

The penalties for a drug crime conviction can range from a small fine to many years in prison. In addition, a criminal conviction for a drug crime can result in the loss of certain rights and privileges. For example, a drug conviction can result in the suspension of a driver's license, disqualification from receiving federal student aid, or loss of professional licenses. It is also important to note that certain drug convictions qualify as strikes under Colorado's habitual offender laws. A third conviction for a qualifying felony offense within 10 years may be punishable by up to 3 times the normal sentence for the crime.

  • Sale or distribution of 225+ grams of cocaine, heroin, LSD, meth, or other Schedule I or II drugs.
  • Sale or distribution of Schedule I or II drugs to a minor.
  • Sale or distribution of more than 2.5 pounds of marijuana to a minor.
