What are the Penalties for Juvenile Crimes in Colorado?

Generally, the penalties for juvenile crimes include probation, therapy, community service, restitution, fines, and/or juvenile detention. Detention is often a last resort, and the court will try to rehabilitate the juvenile first through community service and/or fines. However, if the juvenile is 12 years of age or older at the time of the crime, they could be subject to incarceration for the same crimes as an adult.

When Is a Minor Tried as an Adult in Colorado?

A minor aged 12 to 17 may be tried as an adult in Colorado if they are accused of committing a class 1 or class 2 felony. This may include serious violent crimes or sex crimes. In these situations, the case may begin in juvenile court and be transferred to criminal court. In other scenarios, the charges may be filed in criminal court to begin with. The minor's attorney may file a reverse-transfer motion to get the case sent back to juvenile court, where the penalties are less severe and have fewer long-term ramifications.
