What Is Menacing?

Menacing is a crime in Colorado that involves intentionally placing someone in fear of imminent bodily harm. To be convicted of menacing, the prosecutor must prove that you threatened someone in such a way that they reasonably believed that you would actually harm them.

It's important to note that threatening behavior doesn't have to be physical to be considered menacing. Threats can be verbal, written, or through gestures. Even a simple act like pointing a weapon at someone can be enough to be charged with menacing. The key is whether the other person reasonably believed that you would harm them. That means if you were joking but the other person didn't know that, it's still possible to be charged with menacing.

What Are the Penalties for Menacing in Colorado?

Menacing can be charged as a misdemeanor or a felony, depending on the circumstances. The following are the punishments for a menacing conviction in Colorado:

  • Misdemeanor – Up to 364 days in jail and a fine of as much as $1,000
  • Felony – Up to three years in prison and a fine of as much as $100,000

What Are the Defenses for Menacing?

Depending on the circumstances of your charge, your defense strategy may involve arguing:

  • That you didn't actually threaten anyone
  • That you weren't in a position to actually carry out threats
  • That the threat wasn't reasonable
  • That you were acting in self-defense
  • That you reasonably didn’t know that your statements or gestures would scare anyone
  • That you didn’t have a weapon
  • That you had a weapon, but the weapon wasn’t deadly

Your attorney may also look for other weaknesses in the prosecution's case, such as evidence that was improperly collected or testimony that is unreliable.
