About Denver DUI Charges & Penalties

In Colorado and nationwide, it is illegal to drive under the influence of alcohol, drugs, or a combination of the two. DUI charges may be filed against a driver with a blood alcohol concentration (BAC) of .08% or greater, and/or whose abilities are impaired by alcohol and/or drugs. Even prescription drugs can lead to a DUI arrest, if they interfered with a driver's ability to safely operate a motor vehicle.

The penalties for DUI in Colorado may include:

  • First DUI: 5 days to 1 year in jail, fine of $600 to $1000, 9-month license revocation.
  • Second DUI: 10 days to 1 year in jail, fine of $600 to $1500, 1-year license revocation.
  • Third DUI: 60 days to 1 year in jail, fine of $600 to $1500, 2-year license revocation.

These penalties may be increased if the driver has prior DUI offenses, had a minor passenger in the vehicle at the time of the alleged offense, or caused an auto accident that seriously injured or killed another person.
